This privacy policy applies to SPI (Australia) Assets Pty Ltd ABN 60 126 327 624 and its related bodies corporate (together, "we", "us" or "SPIAA"). It is subject to change from time to time.

If you agree to this privacy policy, you consent to the collection, use and disclosure of your personal information by SPIAA in the manner disclosed by this policy.

  1. SPIAA is bound by the National Privacy Principles
    SPIAA respects and protects the privacy of its stakeholders' personal information and is bound by, and complies with, the National Privacy Principles in the Privacy Act 1988 (Cth) and all other applicable privacy legislation.
  2. The types of personal information that SPIAA collects
    • 2.1 SPIAA collects and holds personal information for its business purposes, including in relation to individuals who are:
      1. actual or prospective customers of SPIAA or of its customers, or who are employees, agents or contractors of a customer or prospective customer;
      2. participants in community appraisals and consultations in connection with SPIAA projects or services or otherwise correspond with SPIAA in relation to our projects and services;
      3. involved in providing goods or services to SPIAA (including where they are employees or agents of companies or others providing such services), or in the selection by SPIAA of suppliers (eg. if they are involved in a tender to SPIAA);
      4. otherwise involved in or connected with one or more of SPIAA's businesses, or who may in future have such an involvement or connection (including for example individuals who work for regulators and councils which make decisions in relation to or communicate with SPIAA)
    • 2.2 Depending on the individual and the purpose for which we collect it, personal information collected and held by us may include personal details including, for example, address, gas meter readings, name, position, contact details, account and credit information.
    • 2.3 We collect personal information in a number of ways, including:
      1. directly from the individual (for example, customers) or those on whose behalf an individual may provide information to us (for example, customer's agents or employers);
      2. from third parties including for example, our related companies, our suppliers and contractors, and from organisations that individuals work with;
      3. from publicly available sources of information;
      4. through service calls (including emergency service calls) and meter readings at private premises; and
      5. from websites operated by SPIAA.
    • 2.4 When an individual browses any website managed by SPIAA, they do so anonymously, except that the IP address of the computer that person is using will be collected. Personal information - such as the individual's name, address, telephone number or e-mail address - is not collected as they browse - only if they provide that information on a web form or by otherwise choosing to disclose it to us.
  3. The purposes for which SPIAA collects, holds, uses and discloses personal information
    • 3.1 SPIAA collects, uses and discloses personal information for business purposes. For example, it collects uses, and discloses information:
      1. to process applications for, make available, and provide, goods and services;
      2. to understand, investigate, analyse, discuss, debate and/or respond to inquiries, feedback and complaints;
      3. to liaise effectively with individuals in relation to SPIAA projects, products and services, including for promotional purposes;
      4. to develop SPIAA projects, products and services, including by conducting research;
      5. to facilitate SPIAA's business operations generally (including any transition phase as a result of a restructure);
      6. to obtain advice and to protect SPIAA's interests (including where appropriate by way of proceedings or another dispute resolution mechanism) in relation to any disputes;
      7. to develop, construct, maintain, upgrade, manage and complete projects, including network, transmission and construction projects;
      8. to manage SPIAA's relationship with customers and potential customers, including to inform consumers of products, services and offers which may be of interest (including by way of direct mail, telemarketing, email, SMS and MMS) and to conduct other marketing activities;
      9. to administer its businesses, including management, billing, credit checks and debt recovery;
      10. to comply with any law, licence requirement, development consent or with any reasonable requirement of any law enforcement or regulatory agency; or
      11. for any other purpose for which you from time to time consent or in relation to which our conduct is permitted under privacy laws.
    • 3.2 You may opt-out of receiving the communications referred to in (h) above by notifying us on the contact set out below.
  4. Types of organisations to which we may disclose personal information
    • 4.1 SPIAA may disclose information for the above purposes to types of organisations including:
      1. the owners and/or financiers of the SPIAA projects;
      2. companies within the SPIAA group;
      3. entities to whom we provide services (including non-related asset owners) but only where the information was collected for purposes relating to the provision of those services to the entities;
      4. parties that provide credit card payment authorisations and merchant and payment facilities;
      5. our service providers and suppliers (including our subcontractors) and consultants and advisers (including legal and financial advisers), their employees, contractors and agents on a confidential basis;
      6. retailers of gas, electricity and water;
      7. gas and electricity market administrators;
      8. contractors providing gas or electricity installation, repair and emergency services or meter reading; and
      9. public authorities (including in relation to land titles).
  5. What, if any, "sensitive information" SPIAA collects or holds
    • 5.1 SPIAA may collect and hold sensitive information about individuals. It only does so where permitted under privacy laws, such as where the individual consents.
    • 5.2 "Sensitive information" is information about an individual's racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record or health.
    • 5.3 SPIAA may collect, use and disclose health information from actual and potential customers and suppliers to process applications for, and provide, goods or services to the individual, or in order that SPIAA can meet obligations in relation to health and safety (for example, occupational health and safety).
    • 5.4 SPIAA may also collect, use and disclose health information in order to take appropriate steps to take into account any health condition in relation to any aspect of its business. For example (and without limitation), it may do so to ensure that it takes into account any health information about you which is relevant to minimising the impact of any construction activities carried out by it or on its behalf in your local area.
  6. Personal information that SPIAA shares with related corporations
    • 6.1 Personal information is collected by various companies within SPIAA. This information may be disclosed to other companies in the SPIAA group for the purposes described above.
  7. Access and correction of personal information
    • 7.1 You are entitled at any time to request details and a copy of your personal information held by SPIAA by contacting:

    • 7.2 We take all reasonable precautions to ensure that the personal information we collect, use and disclose is accurate, complete and up-to-date. However, the accuracy of that information depends to a large extent on the information you provide. That's why we recommend that you:
      1. let us know if there are any errors in your personal information; and
      2. keep us up-to-date with changes to your personal information such as your name or address.
    • 7.3 You may ask us to change any details that may be incorrect or out of date. A basic enquiry about your details will be at no cost. However, SPIAA may charge you for the reasonable costs if incurs in providing you with copies of the information that you have requested if a more extensive search of our records is required.
